Terms and Conditions (Offer Agreement)
These Terms govern the use of the JapanVitamins online store, domain: japan-vitamins.com (hereinafter – the “Online Store”), the rights and obligations of the Seller and the Customer, as well as the terms for concluding and executing distance sales contracts in accordance with the legislation of the Republic of Estonia and European Union law.
1. Definitions
- Seller – OPlsolution OÜ, registration number: 16943560, legal address: Harju maakond, Tallinn, Kesklinna linnaosa, Tuukri tn 19-316, e-mail: info@japan-vitamins.com, phone: +371 29213020.
- Online Store – the website japan-vitamins.com, through which the Seller sells goods remotely.
- Customer – a natural or legal person making purchases in the Online Store.
- Consumer – a natural person purchasing goods for purposes not related to business or professional activity.
- Sales Contract – a contract concluded remotely between the Seller and the Customer in accordance with these Terms.
- Business Days – Monday to Friday, excluding official holidays in Estonia
- Delivery – the transfer of goods to the Customer via courier service or postal service.
2. General Provisions
- These Terms constitute a public offer of the Seller within the meaning of the Estonian Law of Obligations Act (Võlaõigusseadus).
- By placing an order, the Customer confirms that they have read and accepted these Terms.
- All rights to the content of the website (texts, images, design) belong to the Seller or are used under license.
- The Seller ensures the operation of the Online Store in accordance with technical standards and applies data protection measures in compliance with GDPR.
3. Orders and Conclusion of Contract
- Orders are accepted through the Online Store website 24/7.
- To place an order, the Customer selects the goods, provides delivery and payment details, and confirms the order.
- The Sales Contract is deemed concluded once the Seller confirms the order by e-mail.
- The Customer must provide accurate data necessary for order fulfillment.
4. Prices and Payment
- All prices are indicated in euros, including VAT (if applicable). Delivery costs are shown separately.
- Available payment methods: bank card via payment systems (Stripe, Maksekeskus, PayPal, etc.);
- Orders must be paid at the time of order placement.
5. Delivery
- Delivery is available within Estonia and to other EU countries (if indicated on the website).
- Delivery time depends on the chosen carrier and is displayed at checkout.
- Upon receipt, the Customer must inspect the parcel. In case of visible damage, a report must be drawn up with the courier.
6. Returns and Right of Withdrawal
- The Consumer has the right to withdraw from the Sales Contract and return the goods within 14 calendar days from receipt, without providing reasons, in accordance with Directive 2011/83/EU and the Estonian Consumer Protection Act.
- To return goods, the Customer must notify the Seller by e-mail and return the goods in their original condition.
2.1. The withdrawal notice must be sent to the Seller’s e-mail, and the goods returned no later than 14 calendar days from the date of such notice.
2.2. Returned goods must be in original condition: unused, complete with all inserts, manuals, and accessories, and in secure packaging ensuring safe transport.
2.3. For food supplements and vitamins, returns are only accepted if the factory packaging and protective seals have not been opened or damaged. Opened or tampered packaging cannot be returned for health and safety reasons. - The Seller refunds the payment within 14 calendar days after receiving the returned goods. Refunds are made using the same payment method as used by the Customer.
- The Customer bears the direct costs of returning the goods.
7. Limitation of Liability
- The Seller is not liable for:
- delivery delays caused by the carrier;
- failures of internet connection or payment systems;
- actions of the Customer in breach of these Terms.
- The Seller’s liability towards business Customers is limited to actual direct losses.
8. Warranty of Conformity
- For food supplements and vitamins, the Seller’s liability is limited to the product’s shelf life: claims may only be submitted within the manufacturer’s stated expiry period.
- The Consumer has the right to request that the goods be brought into conformity, replaced, or refunded in accordance with applicable law.
- The Seller is not liable where goods have been damaged after delivery, storage conditions have been breached, or the packaging has been opened due to the Customer’s actions.
9. Personal Data
- Customer’s personal data are processed in accordance with the Privacy Policy and GDPR.
- The Seller uses data solely for order processing and lawful purposes.
10. Final Provisions
- These Terms are governed by the laws of the Republic of Estonia.
- Disputes shall be resolved through negotiations, failing which – by Harju County Court (Harju Maakohus).
- Consumers may seek out-of-court resolution through the Consumer Protection and Technical Regulatory Authority (TTJA) or via the EU ODR platform: https://ec.europa.eu/consumers/odr.
- The Seller reserves the right to amend these Terms by publishing the updated version on the website. The version in force at the time of the order shall apply to that order.
